Service

These Terms of Service (“Terms”) govern your access to and use of the CreatorsX website at creatorsx.co and any related services (collectively, the “Services”) provided by CreatorsX (“CreatorsX,” “we,” “us,” or “our”). By submitting an application, creating an account, or otherwise using the Services, you agree to these Terms.

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

CreatorsX is a creator management agency. We provide growth strategy, content management, monetization support, and related professional services to digital creators we accept as clients. The Services include the public website, the application system, and the secure client and staff portals, which may provide tools for file storage, messaging, scheduling, electronic document signing, financial and performance reporting, and syncing statistics from your connected platform accounts.

Submitting an application does not create a management agreement. We review every application individually and reserve the right to accept or decline any applicant for any lawful reason. If accepted, a separate management agreement will govern the specific terms of our engagement.

If we provide you with login credentials, you are responsible for maintaining their confidentiality and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorized access.

To provide certain Services, you may connect third-party platform accounts — such as Instagram, Facebook, TikTok, YouTube, X/Twitter, or OnlyFans — or otherwise grant us access to your accounts. You authorize us to access those accounts and act on your behalf solely to provide the Services. You remain responsible for complying with the terms, policies, and rules of each third-party platform, and you represent that your accounts and the content on them are lawful and in good standing. CreatorsX is not affiliated with, endorsed by, or responsible for those platforms, and we are not liable for any action a platform takes, including access limitations, content removal, or the suspension or termination of your account.

You consent to receive communications from us electronically and to transact with us electronically. When you sign a document, agreement, or acknowledgment through the Services — by typing your name or otherwise indicating your assent — you agree that your electronic signature is the legal equivalent of your handwritten signature and is valid and binding. We maintain records of these agreements within the Services.

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Services, including other users' accounts.
• Upload or transmit any content that is illegal, infringing, harmful, or that you do not have the right to share.
• Interfere with or disrupt the integrity or performance of the Services.
• Use automated tools to scrape, copy, or extract data from the Services.
• Misrepresent your identity or impersonate another person.

You retain ownership of all content you upload to your client vault or otherwise share with us. By uploading content, you grant CreatorsX a limited, non-exclusive license to access, store, and use it solely for the purpose of providing the Services to you.

All trademarks, logos, designs, branding, and software associated with CreatorsX are the property of CreatorsX or its licensors. You may not copy, modify, distribute, or create derivative works of any part of the Services without our prior written consent.

Any references on the Services to revenue, follower growth, views, or other performance metrics are illustrative only. We make no guarantee of any specific results. Outcomes depend on many factors outside our control, including platform policies, audience response, and your own efforts.

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or for any other lawful reason. You may stop using the Services at any time. Provisions of these Terms that by their nature should survive termination will survive.

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, CreatorsX disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, CreatorsX, its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Services. Our aggregate liability for any claim arising from these Terms shall not exceed the greater of $100 USD or the amount you have paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless CreatorsX from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party right.

These Terms are governed by the laws of the United States of America. Any dispute arising from these Terms shall be resolved in a court of competent jurisdiction within the United States.

We may update these Terms from time to time. The “Effective date” above will be revised when we do. If the changes are material, we will provide notice through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
